US Waiver

Saeedposted 9 years ago

Hello,
Can someone help me to get idea about US waiver process, I have a criminal record of "fraud over 5k". Is it a serious charge in US custom and border agency, can my waiver application be rejected. I have no other criminal record and I have been to US numerous times in the past, I applied for waiver in the end of November 2014. it's mid April and there no answer from them, does anyone has similar situation?.

Thanks

To @Ruby
Use the latest forms provided on the US gov't website. Also it is important to disclose everything. (to them not us)
You will have received your court documents. These will show everything you've ever been to court for and the disposition of any and all charges, (unless there are still some pending before the court in which case you won't be getting a waiver.) Hopefully it has been 5 years since you were last convicted. Even though the U.S. DHS doesn't recognize Canadian pardons, enclose a copy of the pardon anyway because that will show well for you. Write the circumstances of each arrest, conviction, sentence and parole/probation and when they were completed. Even if you were arrested but never convicted they will want to see that in the court record. Be thorough, be honest, be remorseful in your written description and you should be approved. ** keep a complete copy of the entire package you submit**
After the first time the renewals will be easy. You'll just update the application, fingerprints, court docs, and provide a copy of your old waiver(s) and duplicate the rest. The amount of time it takes to get your waiver in the mail will vary each time from as little as 3 months up to infinity. I'm waiting for my last renewal and it's been 14 months. Average is about 7 months.

You should only use the forms on the uscis website. The forms often change and ou don't want to be sending in the wrong forms.

So....to change the subject..we are filling out waiver..it's okay to use a downloaded form right? Also we are confused..there was a pardon on a charge yet they knew at border. do.we still include it on the waiver?..do we send the pardon along with it? Do we include any time we were arrested or are they just concerned with what is on the rcmp sheet and pardon? Thank you so much for the info,,this forum has been great .
Wishing everyone a speedy waiver!

not wasting your time at all ...go for it, you'll get it.

Hey. I was charged with 2 counts of possession and 2 of trafficking in 2010. Did 6 months and some probation. Is it even possible for me to get this waiver. Or am I wasting my time lol

Employer's letter includes:
- Employer's company name and address
- Length of employment (longer is better)
- Full time or part time (full time is better)
- Salary, if includes benefits would be an asset
- At the end/bottom, letter issuer's Name, Title, phone number, email address and signature

My husband is in need of an entry waiver to the U.S. because of a
previous drug charge. One of the requirements is an employment letter
from his employer in Canada. Does anyone know exactly what they want included in this letter? Any advice would be greatly appreciated!

Let me know if you get approved. Everything I've seen or read says you usually have to wait 5 years minimum to get a waiver to show your reformity.

The charge was laid 2013, in 2014 got 12 months conditional sentence. Which was completed on Jan 07 2015. border security personal was very nice but did not give me any hint. 2 days ago I got reply for status update, file is still under review without time limit .

How long ago was your charge? What was the punishment? I have the same and have just applied a couple of weeks ago. My charge was 1999. The border agent was very nice and didn't think there would be any trouble.
