US Waiver

Hello,
Can someone help me to get idea about US waiver process, I have a criminal record of "fraud over 5k". Is it a serious charge in US custom and border agency, can my waiver application be rejected. I have no other criminal record and I have been to US numerous times in the past, I applied for waiver in the end of November 2014. it's mid April and there no answer from them, does anyone has similar situation?.

Here is my answer, I cannot speak for John or Ken, as we all run our business differently.

I personally do not take on very many "overstay" applications, for several reasons.

1. The ban is still in effect and my policy is the ban must be within 1 year of the time expiry date.
2. Person is not a Canadian Citizen (I do not accept a client if not Canadian Citizen) (No Exceptions).
3. Paperwork is much more than a standard waiver, and I simply do not have the resources to deal with, as I only have 1 contract person part time helping me. I give my clients a written timeline, I try very hard to keep to that.
4. My company policy is to re-do a waiver for free, if client is not granted one for some reason. I don't like to do work for free, plus 90% of my business are referrals, if you are not happy, I lose business.
5. Client simply does not meet the requirements to be granted an approved waiver.

If I do accept a client with an overstay issue, they must meet my requirements, therefore, all my overstays have been granted, I just don't do many. I have to say that my specialty is more for people who have been denied or are concerned about their criminal record or history. I understand how criminal records work, such as peace bonds, file destruction, c. discharges, ect. I also look at criminal records through the eyes of law enforcement, so tend to focus on the events and rehabilitation - then the actual criminal record. Hope this helps answer your question.

#180 Um....lol ...I admit that back in the day, there were a few times that I came across 1500 pound female animals that wanted to be controlled...but they walked on 2 legs though, shopped at the local malls and I wish they had worn bridal bits..lol I just had to toss in a pig reply..lol

#172, Jazzsax1...lol..how did I manage to find a Bomber fan???? I was not a football fan until I got married, now, 22 years later, I do enjoy being a Rider fan..however, I must admit, that the way Durant was treated, made me lose interest in the Riders, and my heart is not in it as much. Maybe when I see the door slam Chris Jones in the A...I will enjoy it more.... Okay, John and Ken, my macho friends..try controlling a 1500 pound animal with no bridle and no saddle...That is my sport, I used to train horses, now I just ride for enjoyment...LOL..there now I feel equal...

@176 ok john sorry but you are crazy. Most college teams could not beat CFL teams. For one, it's tough for college players to get scouted up here, even going through the combines. If they don't make an NFL team, they are lucky to make a cfl team, or worse a short season league or are forced to go overseas.

So many NFLers and college stars come up here and bust. They have a hard time adapting to the game (which is run to setup the pass, not pass to setup the run). You might have bigger O and D line players, and bigger fullbacks in the US, but college wise those kids are still just learning how to play.

CFL and NFL are going back to the way it was... opened up contracts again to allow "1+1" (one year, plus NFL option window) which will make alot more players who've been cut by NFL teams that still want to play likely to come up because they can work on their play, and if lucky get a call back to the NFL.

We do get NFL money dumped indirectly via TV contracts and everything else.

If you can't tell, I'm a football fan, and I call out idiotic comments when I see them. LOL

FYI --- the main reason CFL is dying in toronto is twofold... 1 ) toronto is loaded with fairweather fans in general for all teams who only follow when they're winning and 2) immigration. Most south asians who are the biggest influx in the GTA could care less about football, even hockey or baseball.... soccer, cricket etc are where it's at.

Can't grow a league and teams in a market where kids aren't encouraged to play the game....

(You should know that, you're in brampton... it's more likely a kid will open a sweets shop or a curry house with his parents than play football)

#177 Yup similar but we use plastic bbs instead of paintball. Essentially a bunch of players that wear military camouflage, eye protection and go to the games range and conduct military type missions against the opposing team. It can get intense with some players..lol

The games range can be old buildings, the woods or anything in general. I have only played in the wooded areas like this.

Played Football, (ran the option in high school) but excelled at Rugby (was disappointed to find out our resident Brit didn't play) and of course MMA and BJJ now. I rarely cage fight anymore but love to do grappling tournaments. I would like 1 more fight after I turn 50 though. Airsoft Ken? It that like paintball?

I can't watch CFL anymore. Loved it as a kid but because I am a huge college football fan, its harder to watch now that most of the top college players don't go either. When they tried the expansion to the US that killed it for me.

NFL only I am sad to admit, and I love college football. Denver Broncos and Nebraska Cornhusker fan here. I will say that Sask Rough Rider Fans are probably the most loyal of any I have seen.

If the CFL was smart, change the game to the NFL rules (relax, I know) and become a farm system for the NFL. You would get NFL money dumped over each franchise, get a better product. I know that sounds a bit "un-Canadian" but good football played by the best players is what I want to see. It pains me to think than Alabama could probably beat most CFL teams. LOL I am sure I am going to feel the wrath of Michelle now!!

Like I said I’m not trying to sow bad seeds here but I imagine all 3 of the specialists have something they’re each EXCEPTIONALLY good at where waivers are concerned.

#165 Yes I want to thank you for the good words and the clarification. It is true that we specialize in different things and your clarity is impeccable. I wish I had you on my team as we are positioning/have positioned people all across Canada(Except Saskatchewan) and slowly Europe.

If my other plan works, then we will be getting a large number of pardon applications from all across Canada and I would like to contract them to you for processing...since you are the clearly recognized expert with these applications. Your prior experience with Edmonton P.D. is something that makes you invaluable.

Overall, I am happy just being able to present some info that can help people. Our website gives away a lot of free info and we make less than 1 cent doing it. It is my goal to help people to not have to file for these stupid waivers if they qualify for a lifetime clearance. I want them to be able to save if possible.

I am also honoured to know Michelle and John as they are people that I would not mind meeting up for maybe a dinner and drinks in Canada or Europe...and the bill is on me.... I respect and enjoy them both as colleagues. The forum is always a bit harder for me since I am a face to face kind of person as opposed to a keyboard...lol

Hi Ken, Yes, I remember, I was thinking that it was Alberta Pardons at the time, which sounds like something they would do or Federal Pardons, but Federal won't know what a September letter is as they hardly know what a standard waiver looks like.

#156 I think there is a bit of confusion here. I think you may have taken things the wrong way. This is kind of why this forum can be hard since there is no way for a person to see body language or hear anything verbally. Mistakes can be common here and it is unfortunate.

Anyway, getting back to the info..you already have the info I said before about the 5 years remaining on your case. Again, I think there may have been a bot of confusion here.

I understand why he got cleared and he actually could have initially got a September letter based on what I quoted before as per procedures....and that is all I will say about his topic. Michelle...I don't know if you remember when I told you about an Alberta Waiver company once put an angry post on our Facebook Business Page. She was upset stating that we are not the only ones that specialize in getting SeptemberLetters. I wrote back to her and inquired if that was a service that she offered as well. I also asked that if she offered it....then why does it not show up on her website. I never got a reply back.

The company that put that post was the Canadian Legal Resource Centre and it was in mid-2017 I believe. This is the only thing that I know about her was the angry post that she gave me. I think I still have the post in my email.

@Adelaide - they are a paralegal firm. They do everything. Basically one stop shop, jack of all trades, master of none. They have alot of things listed on their website, alot of copy and paste. Sure they have helped many people but one thing I've found over the years is when you need significant help in a legal area work with people who FOCUS rather than be generic. If I don't know right off the top who would be handling my file and why they are the best fit I would be going to someone else.

What I like about John, Ken, and Michelle is they are VERY SPECIFIC in what they handle.

John handles waivers, his partner handles pardons.

Ken is very clear on what he handles, and who in his firm handles what.

Michelle handles waivers and pardons but has the police background and experience to rely on. When she doesn't, she asks.

Basically, you *KNOW* what you are getting with the three (other than the sometimes arguing between Ken and John) --- and in my opinion will get much better support with each of them. Remember, they've been doing this for YEARS and have their ears to the ground.

Besides --- a cell phone, a scanner and not much else is what you need to get this done working with any of the three.

Personally I will use local fingerprints, and then one of the above when it comes time to apply. They have proven their knowledge is top notch.

@Adelaide, I am not familiar with Canadian Legal Resource Center Inc., so unable to comment on their work. I do suggest to check reviews on the BBB even if they are not a member. I don't believe they fall under the so called "discount waiver services". It seems that they are similar to a lawyer firm. Unfortunately, there are several "bad" waiver/pardon services that have created this term that Ken uses. Some of these companies still exist and are scamming people unfortunately. Others have closed shop and many people lost a great deal of money and never received their Pardons or Waivers. Part of this forum is to bring awareness to the "bad" companies and to do your research before you hire anyone. Thanks!
