Waiver application processing times

Got your I-194?

Reply here with how long it took. Months, weeks, days...

Replies (recent first):

@Jazzsax1 he had a 1 year with another company.

Interestingly the record isn't THAT minor.

2002 Assault with intent to resist arrest, Trafficking as well

2004 Possession of scheduled substance

2005 Dangerous operation of motor vehicle.

Anyways i am pleased but went hard on the letter about the trafficking.

John - was this 5 year a first time applicant or renewal? How long after conviction?

jazzsax1 replied 5 years ago   #1581

#1605, John Rogers, I have been helping a few clients send trace emails, and no we have not received an actual EMAIL reply. We receive the automated response, but nothing more.

Michelle replied 5 years ago   #1580

Another waiver in today for a client that was super fast.

He picked up his package from me on November 8 2018 but claims he handed it in in January.

That doesn't SEEM possible because of the Shutdown that December 22 to January 25th.

I am going to speculate he handed it in around Christmas because he did mention "around Christmas" first.

5 year waiver.

Also, people are emailing Homeland Security to follow up on Waivers after 150 days. They are all getting an automated response, but it seems most are not getting the ACTUAL response even a week later. I am telling people to give them time due to the obvious backlog, but does anyone after January 25 2019 have an actual EMAIL response?

John Rogers replied 5 years ago   #1579

@Ferry this doesn't happen enough for a clear timeline, but the last time someone applied it was 60 days. I hope you got 5 years, then this will be a little more "worth it".

John Rogers replied 5 years ago   #1578

@johrogers thank you explaining I had no idea what to do they weren’t telling me anything so I went yul to apply for duplicate how long will this take? I hope it doesn’t get lost again I already lost 3-4months. Thank you for reading and replying.

Ferry replied 5 years ago   #1577

Depends if he's rural or not and where you live. Your postman if he's in brampton probably votes with the sea of red to be strategic even if his union told him to vote orange.

Wet colds are far nicer than dry colds. Much easier to ski in. Dry colds suck.

jazzsax1 replied 5 years ago   #1576

@Jazzsax1 wouldn't a postman with a strong Union vote NDP? ON my 'left wing' Facebook page I follow they think the Liberals are 'corporate sell outs'.

Don't play into my assumptions that OF COURSE you have a pet polar bear.

But ours is a "wet cold". I think yours is a "dry cold". Much nicer.

John Rogers replied 5 years ago   #1575

@JohNRogers you realize the reason the Canada Post guy didn't do his job? He voted liberal. They only do their job when they are called to the table for it.

@JohnRogers Buy a parka and call in the army. You want to see horribly cold? My polar bear won't even piss outside it's so cold in the west.

jazzsax1 replied 5 years ago   #1574

@Ticktock send an email. Remember my earlier post about stuff being lost in the mail? Also if you have trafficking this will take about a year or more even if it is your 4rth. If not, then I am not sure why. Email for sure.

@Ferry which border do you live closest to? I should have emphasized this more, but did you really think Homeland Security was going to give you information over the telephone? Your not even American.

YOU MUST GO IN PERSON. If you were in my area I would say Niagara Falls. You explain you want to talk to someone and show the emails. You have your document to file for a replacement and the money. BUT then you ask for a 'favor'. "Can you please check if its a 1 or a 5 year waiver? If its a 1 year waiver I will just come back and re-file". Works every time. If its a 5 year waiver you then get the replacement.

For everyone, "fault" is not the issue with Homeland Security. I had a client where they emailed saying they sent it to 18 Fairbanks Lane (These are not the real addresses) The client pointed out that on the forms they had put 8 Fairbanks Lane. Homeland Security asked for proof, so we sent them a copy of the I-192 forms. They agreed they made a mistake and then told the client to pay for a duplicate copy anyways. This was in the last 2 years.

Canada Post is usually the problem. Ironically ALL rejection letters now come registered mail. So if you are turned down, you will get the decision FOR SURE. If your waiver is granted, then its a crap shoot.

John Rogers replied 5 years ago   #1573

Update: I called every where post canada/ border they told me I must pay even tho it’s not my fault, I did today they said even tho it’s not my fault I have to pay, now awaiting a for a duplicate he said 2-3 weeks and no one told if it was one year or not..already spent 1500$! How can they lose it?

Ferry replied 5 years ago   #1572

I applied for a waiver late November 2018, no mail nothing. Has anyone recieved waiver similar to my time line recently. This is my 4th waiver.

Ticktock replied 5 years ago   #1571

@Newleaf the deadly weapon charge isn't as much the issue as your sentence. That is a very long sentence for Canada. Your personal letter needs to be very "on point".

Timing:

@Michelle the emails are working again. If the waiver is past 150 days, email once a month

I have had some very bizarre results since the shutdown.

-One waiver submitted February 6 granted February 19 for 1 year
-One waiver rejected February 19 (expected)
- One Letter indicating the person was sent a letter and they closed the file dated Feb 11
-One Five year waiver (his first) dated February 24 (Submitted September but got a letter asking for more details in November)

I usually follow up with clients but have a co-op student we are training for some special projects so am a bit behind. I will keep posting some updates as I get more data.

@Ferry you need to find out if it was a 5 year waiver, or a 1 year waiver. If it was a 1 year waiver or even a 2 year (rare) then just re-apply. Only waste the money on a duplicate if you got 5 years. October and November seem to be months where Homeland Security sent out waivers and letters and a higher number of people than usual did not get them.

We had a situation with Canada post recently. We ordered a battery for the digital camera and it didn't but Canada Post tracking had it as delivered. Now we have had a cold and tough winter for US in central Canada (shut up Jazzsax1 and everyone in the Prairies) and I knew something was up so I put a note in my mailbox for the postman to come see me and a copy of the page that said the item was "delivered" and magically he comes with the battery and a bunch of mail and says it was in the "grey box at the corner".

Bullshit. Do your job please.

John Rogers replied 5 years ago   #1570

#1594 @Newleaf

That was a lifetime ago! I don't see why it should be too much of an issue for a waiver as I'm sure you're quite a different person now. Best of luck with it.

Adelaide replied 5 years ago   #1569

@1591

I had an assault with a deadly weapons charge in 1992. Served 5 years and I’ve been a model citizen since.

Newleaf replied 5 years ago   #1568

Hey everyone, well,i had a conviction from something that happened in 2005,i applied for a waiver in 2016.....i got the answer in 2018! Yes two YEARS , my waiver was good for 1 year.I had no issues crossing the border and I have recently replied for my renewal, which i heard takes much shorter.

Canada replied 5 years ago   #1567

Hi, I submitted my application October 2018 I sent an email a Week ago to inquire about the status they sent me an email today that they had sent an approval in November 2018! I must submit i824 for a duplicate plus 460 usd! I called post office they said they won’t be able to find the mail since it’s been so long. Has this happened to anyone? I didn’t even know thank god I emailed them!

Ferry replied 5 years ago   #1566

#1590 @Newleaf

May I ask what made you inadmissible to the US in the first place?

pending further review...

Does that phrase typically mean an application is in Secondary?

Any experts wish to weigh in on this?

Adelaide replied 5 years ago   #1565

I sent them a email to get a update and this was their reply:

Your application is on file with the Admissibility Review Office. It is currently pending further review. Due to the individual circumstances of each waiver application, there is not a set timeframe to give as to when an application decision will be completed

Newleaf replied 5 years ago   #1564

#1587 @Newleaf

Do they explicitly tell you that your waiver is in secondary or is that something your just surmise because it's been since August?

I'm just curious. I know the government shutdown affected the processing times of a lot of things.
