Replies (recent first):

Received my 5 year waiver today.

Applied December 16, 2016. Third application (1 year, 3 year, & now 5 year!) Approved April 24.

Completed them all myself. First one took over 12 months to be approved, 2nd one was 3 months.

Hey all

I am wondering if anyone can help me out and give me a good advice, I am not a Canadian I applied for 212 waiver through the Embassy in my country to waive the 5 year ban so I can go back to school and continue my studies , actually I was told that the counselor has submitted the waiver in my behalf at the end of Jan'2017 when they refused my F-1 visa application because of the 5 years ban they told also that they can't speed up the process or guarantee the results this first time for me and I don't know if I should hire a lawyer they didn't also ask me to pay any fees. Essentially I deported by CBP in Detroit last summer 2016 after a vacation because I refused to withdrawal my application and pay for my return flight ticket.

Any suggestion should I wait for the waiver or it most likely gonna be declined and I have to look for another destination to continue my degree?

Yes, this was my first waiver application, I prepared it myself.

I re-read it yesterday to see if I could see anything missing or issues with the package.
It was actually a very well prepared document, (if I may say so myself) the references were first class high level people both working for the Government here in BC and neither were contacted.

My tax issue was from more than 7 years ago but the court record shows 2013 as the year it was dealt with, so maybe not enough time has passed.

There are about 5-6 things they outlined in the letter as to why it may have been declined, time frame was one of them.

Not sure I'll bother with an appeal as I stated earlier, I'll just wait a year or so, then see if I can be bothered to apply again.

Hi Kiwi
My suggestion to you would be to appeal it , as on the first time i did my waiver application, i received a letter stating that i was denied due to insufficient information and because i did not respond. I did have a lawyer assist me and he to had not received anything. I appealed it and i received a waiver for 6 months, and then one for a year, and then today my third one for 5 years. So please take the time, you may be surprised, and if not you tried.

I finally got a response but not what I was wanting.

When I checked my mailbox I get a pickup notice for a letter at the post office, seems strange as everyone else just got regular mail, the response was sent via registered letter.

Declined, well sh*t that was a major disappointment.

I suspect that the new regulation requires them to make a decision within 45-60 days after an inquiry is made (after a certain time period) and they didn't have all the information needed to approve the Visa Waiver, so I was declined.
I can appeal the decision for a fee of $110 but the response must be received within 30 days of them mailing the response which took about 16 days for me to receive it, so I'm not even going to bother with an appeal as getting it back to them within 30 days is going to require too much hassle and the cost of a rush courier etc..

The document doesn't give any reason for the decline, just a bunch of legaleeze and impossible to understand restrictions and rules for appealing, if their intent is to deter anyone from appealing they did a good job.

I'll wait a bit and then start a new application.

I emailed too and got the same generic response "received and being processed... no set time frame" blah blah blah. I applied in Nov and I have no criminal record (just had an overstay) it shouldn't be that hard. Plus It's been 12 years since then.
I live on a border town and am married to an American... seriously I just want to be able to take my kids across the border (5 min away). It's so frustrating

Woo hoo they emailed me back and said a decision was made April 17!!! I hope it is a Yes! However I am out of town till saturday. I'm on the road heading to Saskatchewan and feel like turning around.. lol

@puzzled that's awesome! People reported on here that they just email random replies lol. The replies just can't be trusted. I think they reply just to make us feel better. Good for you!!!!

@samianauman I would email again and see what they say apparently they don't actually check your file anyway.

Applied Dec7th, sent in inquiry last Thursday, they replied with a not yet. Found my 5 year waiver in the mail box yesterday! Dated April 17th
